These terms and conditions, and the Privacy Policy, (together the “Terms”) apply to the entire website found at the domain name https://www.cma.gov.ae/, all pages within such site and their relevant URLs and all sub-domains and the Creative Media Authority customer portal (together, the “Website”), including without limitation all contents of the Website, any correspondence (sent by e-mail or through the Website) between you and the Creative Media Authority (or any person or company that controls, is controlled by, or is under common control with the Creative Media Authority, including any and all officers, directors, employees, agents and representatives thereof, together “CMA” or “our” or “we”) and any information, forms or materials which you submit to CMA.

By accessing and using the Website, you agree to these Terms. Please read them thoroughly before you start using the Website.

Modification of Terms

By using the Website, you understand and agree that CMA can change the Terms or other site-related policies and information at any time without prior notice, to the extent permitted by applicable laws.

Once updated, these Terms will be effective immediately upon posting on the Website unless noted otherwise. You are expected to review the Terms each time you visit the Website to stay informed of any updates. When you continue using the Website, you signify your acceptance of any changes.

Our Intellectual Property

Unless otherwise stated, all creative works, text, data, software links, audio content, audiovisual content, features, functionality, footage, graphics, images (photographs), illustrations, forms and look and feel attributes, CMA trade marks and logos, copyrighted material and other intellectual property rights in all information, documents or material on the Website and any technology or code making up any CMA widget ("Content") are owned and/or controlled by CMA or its licensors.

Any downloading, reproduction, republication, extraction, modification, copying, distribution, transmission, display or sale of Content or any other part of the Website without the express written consent of CMA for any purpose is strictly prohibited.

If you breach any of the provisions in these Terms, in addition to all other legal remedies available, your permission to use the Website and your license to use the Content immediately and automatically terminates, and you must immediately delete, return or destroy any downloaded or printed extracts of Content from the Website.

No content or any other part of the Website may be reproduced, republished, extracted, modified, copied, distributed, displayed, stored or otherwise included in any other website or any public or private electronic retrieval system or service without CMA's specific prior written permission.

The trademark and trade name "Creative Media Authority" is owned or controlled by Creative Media Authority or its affiliates. You shall not use or display publicly the "Creative Media Authority" trademark or the name “Creative Media Authority” without the prior written consent of the Creative Media Authority.

The Website may contain or make reference to trademarks or other proprietary intellectual property rights of CMA, its partners or of other third parties. No license to or right in any of these trademarks or other proprietary intellectual property rights is granted to or conferred upon you by reason of such reference.

The Website and Content are protected by copyright, trademark, and other laws of the United Arab Emirates and all other relevant countries. Except as expressly provided in these Terms, CMA and its licensors (if specified by CMA) exclusively own all right, title and interest in and to the Website and Content, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Website or Content.

Subject to your compliance with these Terms, CMA grants to you a limited, non-exclusive, non-transferable license, without the right to sublicense, to access, view, download and print, where expressly permitted, any CMA Content solely for your personal and non-commercial purposes, revocable upon notice by CMA without need to ascribe reasons for doing so. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Website or Content, except as expressly permitted in these Terms. While CMA endeavours to ensure that the Website is available 24 hours a day, you hereby acknowledge that CMA shall not be liable if, for any reason, the Website is unavailable at any time or for any period or if your access to the Website is suspended.

You are responsible for ensuring that your computer system, mobile telephone or other communication device meets all relevant technical specifications necessary to use the Website.

To access the Website or the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide is correct, current, and complete and that you immediately notify CMA if any information provided becomes inaccurate, outdated or incomplete.   • Post, distribute or otherwise upload any content that breaches UAE laws or the CMA regulations and codes (including the CMA Content Code, as may be amended, reissued or renamed from time to time) or that is defamatory, libellous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially, or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication, advertising or solicitation.

  • Upload, post, email or otherwise transmit any materials that you do not have a right to transmit under any law or under a contractual relationship.

  • Use the Website to commit a criminal offence or to encourage others to engage in any conduct which would constitute a criminal offence or give rise to civil liability.

  • Obtain or attempt to obtain unauthorised access to, interfere with, damage or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website and/or customer portal or any private or member account areas on the Website, nor to impersonate any person or misrepresent your affiliation with another person.

  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.

  • Upload any material that infringes upon or violates the intellectual property rights of others, or take any actions that could infringe upon, damage, or interfere with the intellectual property rights of CMA, the Abu Dhabi Government, or third parties.

CMA and the Abu Dhabi Government have the right to take legal action against anyone engaged in illegal activities, such as collecting or storing personal information about others.

You agree to comply with all applicable laws and regulatory requirements relating to your use of the Website and not to use the Website to distribute any information or data in contravention of any regulation or legislation (including, but not limited to, regulation or legislation governing financial services, money laundering or anti-terrorism).

If CMA considers that you have breached any of these Terms or have otherwise demonstrated inappropriate conduct when using the Website, CMA reserves the right to:

  • Warn you that you have breached these Terms, and require that you stop such conduct immediately or within such timeframe as determined by CMA.

  • Delete any material or content that may have been posted without notice to you.

  • Take measures (including terminating, suspending or restricting your access) to, and preventing you from using the Website immediately and without notice.

  • Report your activities to an internet service provider or relevant authorities, and/or take legal action against you.

Security

You must treat any and all information relating to accessing your account as confidential, whether this is chosen by yourself or assigned to you. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. It is your responsibility to handle sensitive information about your account and personal information carefully and not to disclose this to a third party.

We have the right to disable, without notice, any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. This will result in you being unable to access the Website.

Liability

Save for death or personal injury arising out of CMA’s negligence or any liability which cannot be excluded by law, under no circumstances shall CMA, our affiliates, employees, directors, officers, agents or suppliers be liable for any indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with the use of or inability to use the Website, including, without limitation, damages for loss of profits, loss of goodwill or loss of data. Nothing in these Terms is intended to impact any rights you or CMA may have under applicable law.

Choice of Law and Jurisdiction

Your use of the Website and the Terms are governed by UAE law, and you agree to submit to the non-exclusive jurisdiction of the Abu Dhabi courts. CMA retains the right to initiate proceedings in your local courts.

Payment & Refunds

By making a transaction on the Website, you understand and agree to comply with the following Payment Terms and Conditions:

  • The details you are asked to submit will be provided directly to our payment provider via a secured connection and no payment information is stored in the Website.

  • We do not provide any payment service either to you or to third parties. All online payments are processed via your own issuer / payment provider and the payment providers in partnership with us.

  • We acknowledge and facilitate online payments as above utilizing Credit/Debit Cards (Visa, MasterCard) and Bank Transfers (details are provided upon request). Please ensure all payment details provided are accurate and up-to-date.

  • All transactions are processed in AED. Fees, fines and other prices on our Website exclude taxes (unless otherwise stated), which will be calculated at checkout in accordance with UAE taxation laws (as applicable).

  • The breakdown of the fees, fines and other prices, and any additional credit card charges, are displayed before checkout. When you request a service, you agree to all amounts, additional charges and the final ‘Total' amount which is displayed to you.

  • CMA will provide a digital invoice in English by email.

  • Any purchase, dispute or claim arising out of or in connection with this Website shall be governed and construed in accordance with the laws of the UAE.

CMA will NOT deal with or provide any services or products to any OFAC (Office of Foreign Assets Control) sanctioned countries in accordance with UAE law.

We reserve the right to update these Payment Terms and Conditions at any time. Changes will be effective immediately upon posting on this page.

You may be directed to a third-party website (a payment gateway) to make online payments to CMA. This third-party website is subject to its own terms and conditions and its privacy policy. If you decide to access such a website, you do so at your own risk. Please note that CMA does not collect or store any individual payment information (such as credit card or bank information) from you.

For cancellations and refunds:

  • Once an application/request for a service is submitted and payment is made, you may cancel/withdraw the application/request for a service, however the following default position will apply:

  • No refunds will be issued for processed/cancelled applications/requests.

  • Any fees paid are non-refundable and non-transferable.

  • Under exceptional circumstances, including where you have the right to a refund under applicable law, CMA may, in its absolute discretion issue a refund (in full or in part) of the fees paid by you.

  • Refunds are processed within 30 business days of approval.

  • Any applicable refunds will be issued only through the original mode of payment.

General

You agree to defend, indemnify and hold CMA, our directors, agents, affiliates, licensors and suppliers harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to your use of the Website and/or any acts or omission in breach of any provision of these Terms.

Any failure to exercise or any delay by either party in exercising its rights or remedies under these Terms shall not be construed as a waiver thereof. The rights and remedies provided by these Terms are cumulative and are not exclusive of any rights or remedies provided by law.

If a provision of these Terms is or becomes illegal, invalid or unenforceable in any jurisdictions it shall not affect the legality, validity and enforceability in the said jurisdiction or any other jurisdiction of the remaining provisions.

You acknowledge and agree that these Terms constitute the complete and exclusive agreement between you and CMA concerning your use of the Website and any purchase by you of any services through the Website, and supersede and govern all prior proposals, agreements, or other communications.
